Cell Phone Charms Import / be sued? Can I get sued by parents or others for choking hazards? I'm going to import small plastic charms mobile phone in the U.S. for resale. The product is too small to put a long warning or any warning on it. Each charm is 15mm x 15mm with a string of 8 inches to attach to your cell phone as a backdrop. Can I get sued if a child choking on even if it's not a toy?
You can be prosecuted for anything. Does it go any where? That is debatable.
First, you'll want to study, operating as a company to protect your property is something that you need legal advice.
Second, you want to do a little research to determine if these charms legal to import and resell.
Honestly, you want actual legal advice, not just advice internet. Nothing too serious, just someone who can tell you with full support that you need to do to protect yourself.
You can be prosecuted if a child is choking. Is the law. If you sell something that has some insecure / dangerous component, you may be liable for any and all hazards.
In addition, since I suppose it is a cheap item, you must also ensure that no lead in manufacturing. This may increase the potential liability.
